1.0 ESSYLIFES TERMS AND CONDITIONS

  • The Terms of Use stated herein constitute a legal agreement between you and Jayam Sdn Bhd, Company No 202401038343 (1584190-W), a company incorporated in Malaysia and having its registered address Unit 8A, Pearl Court, No.61, Jalan Thamby Abdullah, 50470 Brickfields, Kuala Lumpur, Malaysia
 
  • Welcome to the Essylifes mobile app. These Terms of Use govern your access and use of Essylifes and the use of any services, information and functions made available by us at the Platform (“Services”). Before using this Application and the services provided, you must read carefully and accept these Terms of Use and all other terms and conditions and policies pertaining to the use of the Platform and/or the Services (collectively referred to as “Essylifes Terms and Conditions”) and you must consent to the processing of your personal data as described in the Privacy Policy set out at https://www.essylifes.com/privacy-policy/. By accessing the Platform and/or using the Services, you agree to be bound by Essylifes Terms and Conditions and any amendments to the foregoing issued by us from time to time. If you do not agree to Essylifes Terms and Conditions and the Privacy Policy, do not access and/or use this Platform and/or the Services.
 
  • Essylifes reserves the right to change, modify, add, or remove portions of these Terms of Use and/or Essylifes Terms and Conditions at any time. Changes will be effective when posted on the Platform with no other notices provided and you are deemed to be aware of and bound by any changes to the foregoing upon their publication on the Platform.
 
  • If you are under the age of 18 or the legal age for giving consent hereunder pursuant to the applicable laws in your country (the “legal age”), you must obtain permission from your parent(s) or legal guardian(s) to open an account on the Platform. If you are the parent or legal guardian of a minor who is creating an account, you must accept and comply with these Terms of Use on the minor’s behalf and you will be responsible for the minor’s actions, any charges associated with the minor’s use of the Platform and/or Services or purchases made on the Platform. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing this Platform and/or Services
 
  • Each time you access or use the Services, you agree to be bound by the Terms of Service (including the binding arbitration provision located here along with our privacy notice, and any additional guidelines, terms, procedures or rules that may apply to a specific feature of the Services (collectively, the “Agreement”). Certain other terms and conditions may be applicable to certain of the Services depending on who is using them, so please be aware of any additional terms and conditions that may be displayed (a) with the Services that you may use from time to time as those will also be applicable to you and form part of our Agreement with you, which will be applicable to you and be a party of your agreement.
 
  • You acknowledge that we will use information we obtain about you in connection with your access to and use of the Services in accordance with our Privacy Notice. We may provide Services that are not described in these Terms of Service, or customized Services: unless we have entered into a separate, signed agreement that expressly supersedes these Terms of Service, these Terms of Service will apply to those Services as well.
 

2.0  USE OF THE PLATFORM AND/OR SERVICES

 

    • We grant you a non-transferable and revocable license to use the Platform and/or Services, subject to these Terms of Use, for the purpose of connecting job seekers with Hosts (companies or individuals) who need temporary or part-time staff on short notice. Any breach of these Terms of Use shall result in the immediate revocation of the license granted herein without notice to you.

 

    • Content provided on this Platform is solely for informational purposes. The services expressed on this Platform are those of the Host and are not made by us. Submissions or opinions expressed on this Platform are those of the individual posting such content and may not reflect our opinions.

The Essylifes App is a mobile application designed to connect job seekers with Hosts (companies or individuals) who need temporary or part-time staff on short notice.

 

    • Services and related features that may be made available on the Platform may require registration or subscription. Should you choose to register or subscribe for any such services or related features, you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. Every user of the Platform is solely responsible for keeping passwords and other account identifiers safe and secure. The account owner is entirely responsible for all activities that occur under such password or account. Furthermore, you must notify us of any unauthorized use of your password or account. Essylifes shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

 

    • We may, from time to time and without giving any reason or prior notice, upgrade, modify, suspend, or discontinue the provision of or remove, whether in whole or in part, the Platform or any Services and shall not be liable if any such upgrade, modification, suspension or removal prevents you from accessing the Platform or any part of the Services.

 

    • We reserve the right, but shall not be obliged to:

 

    • monitor, screen or otherwise control any activity, content or material on the Platform and/or through the Services. We may in our sole and absolute discretion, investigate any violation of these Terms of Use contained herein and may take any action it deems appropriate.

 

    • prevent or restrict access of any unauthorised user to the Platform and/or the Services;

 

    • report any activity it suspects to be in violation of any applicable law, statute or regulation to the appropriate authorities and to co-operate with such authorities; and/or

 

    • to request any information and data from you in connection with your use of the Services and/or access of the Platform at any time and to exercise our right under this paragraph if you refuse to divulge such information and/or data or if you provide or if we have reasonable grounds to suspect that you have provided inaccurate, misleading, or fraudulent information and/or data.

 

    • In the event Essylifes has a reasonable ground to believe that some suspicious posting taking place for a post by Host , Essylifes has all the legal rights to make first hand investigation and the right to take all necessary actions, including lodging a police report against the Host, if Essylifes has a reasonable ground to believe any misleading or legally classified illegal event/activity taking place.

 

    • If at any one time Hosts’ job postings contain illegal activity and/or against the Malaysian law, Essylifes has rights to request for additional details and verification from both hosts and employees.

3.0 DEFINITIONS

“Conditions” mean these Terms and Conditions of this App;

“Contract” means the contract formed when Employee accepted the posting placed by Host on the Platform for the purpose of attending the temporary work been posted by the Host.

“Essylifes App ” means a platform posting a temporary job with immediate salary upon completing the assigned task/job on short notice.

Essylifes App owned by Jayam Sdn Bhd, Company No 202401038343 (1584190-W), a company incorporated in Malaysia and having its registered address Unit 8A, Pearl Court, No.61, Jalan Thamby Abdullah, 50470 Brickfields, Kuala Lumpur, Malaysia

Essylifes Terms and Conditions” mean these Terms and Conditions of Sale and all other terms and conditions and policies pertaining to the use of the Platform and/or the Services;

“Host” means the company/person who has registered as a user of the APP as the job host. In the Essylifes App, Host will be known as EMPLOYER

“Job Seekers” means the person who has registered as a user of the app for the sole purpose of using this platform for getting a temporary job placed by Host. In the Essylifes App, job seeker will be known as EMPLOYEE.

“Platform” means the Essylifes mobile app;

“Services” means the use of any services, information and functions made available by Essylifes at the Platform;

Key Features

Hosts: Companies or individuals can register as hosts by providing detailed information, including company details, contact information, nature of business, bank details, and self- declaration.

Job Seekers: Individuals seeking full-time or part-time work register by providing personal details, emergency contact information, bank details, job preferences, and supporting documents.

Job Posting: Hosts can create job postings specifying work location, contact details, job type, number of workers needed, work dates and times, payment methods, and any special requirements.

The system allows for flexible job postings, including the ability to extend work hours and make amendments before a job is accepted by a seeker.

Registration: Hosts and job seekers complete detailed registration forms with necessary verifications and documentation.

Creating Job Postings: Hosts create job postings with specific details and requirements. New postings trigger notifications to nearby job seekers.

Job Acceptance: Job seekers receive notifications and can accept job postings, leading to further discussions with the host if needed.

Job Monitoring: Real-time monitoring and updates ensure job seekers reach the job site on time and start work as agreed.

Job Completion and Payment: Upon job completion, hosts verify the work, and payments are processed accordingly.

Feedback and Reporting: Post-job feedback and detailed reports ensure continuous

 

    • Any reference in these Conditions to any provision of a statute shall be construed as a reference to that provision as amended, re-enacted or extended at the relevant time.

       

        • Any references to “Essylifes” in these Conditions refer to both Essylifes’s actions on its own behalf as Seller and/or as the operator of the Platform and/or as the agent of Hosts as Sellers in respect of each and every Contract.

4.0 USER SUBMISSION

 

    • Hosts and Job Seekers grant us a non-exclusive licence to use the materials or information that you submit to the Platform and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, “Submissions”). When you post comments or reviews to the Platform, you also grant us the right to use the name that you submit or your username, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.

5.0 INTELLECTUAL PROPERTY RIGHTS

 

    • All intellectual property rights, whether registered or unregistered, in the Platform, information content on the Platform and all the design, including, but not limited to, text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code and software (collectively referred to as “Intellectual Property”) shall remain our property or where applicable, our affiliates or third party intellectual property owners. The entire contents of the Platform also are protected by copyright as a collective work under Malaysia copyright laws and international conventions. All rights are reserved.

 

    • No part or parts of the Platform may be reproduced, reverse engineered, decompiled, disassembled, separated, altered, distributed, republished, displayed, broadcasted, hyperlinked, mirrored, framed, transferred or transmitted in any manner or by any means or stored in an information retrieval system or installed on any servers, system or equipment any Intellectual Property without our prior written permission or that of the relevant Intellectual Property owners. No party accessing the Platform shall claim any right, title or interest therein. Permission will only be granted to you to download, print or use the Intellectual Property for personal and non-commercial uses, provided that you do not modify the Intellectual Property

and that we or the relevant copyright owners retain all copyright and other proprietary notices contained in the Materials.

6.0 OUR LIMITATION OF RESPONSIBILITY AND LIABILITY

 

    • The Platform and all data and/or information contained therein and/or the Services are provided on an “as is” and “as available” basis without any warranties, claims or representations made by Essylifes of any kind either expressed, implied or statutory with respect to the Platform and/or the Services, including, without limitation, warranties of non-infringement of third-party rights, title, merchantability, satisfactory quality or fitness for a particular purpose. All data and/or information contained in the Platform and/or the Services are provided for informational purposes only.
      • Without limiting the foregoing, Essylifes does not warrant that the Platform and/or the Services or the functions contained therein will be available, accessible, uninterrupted, timely, secure, accurate, complete or error-free, that defects, if any, will be corrected, or that this Platform and/or the server that makes the same available are free of viruses, clocks, timers, counters, worms, software locks, drop dead devices, trojan-horses, routings, trap doors, time bombs or any other harmful codes, instructions, programs or components.

       

        • Essylifes and all of its respective officers, employees, directors, agents, contractors and assigns shall not be liable to you for any losses whatsoever or howsoever caused (regardless of the form of action) arising directly or indirectly in connection with:

    • any access, use and/or inability to use the Platform or the Services;

    • reliance on any data or information made available through the Platform and/or through the Services. You should not act on such data or information without first independently verifying its contents;

    • any system, server or connection failure, error, omission, interruption, delay in transmission, computer virus or other malicious, destructive or corrupting code, agent program or macros; and

    • any use of or access to any other website or webpage linked to the Platform, even if we or our officers or agents or employees may have been advised of, or otherwise might have anticipated, the possibility of the same.

7.0 SALES s PURCHASE

 

    • Essylifes App shall provide Service(s) on behalf of Employer(s) and Employee(s) shall purchase the service in compliance with the Contract.

 

    • Once matches are being confirmed, all cancellation taking place will be deal as per the cancellation policy agreed and accepted by both Host and Job Seeker when submitting their registration as Essylifes App user.

 

    • Any information made available on the Platform in connection with the supply of service, including photographs, drawings, data about the extent of the delivery, appearance, performance, dimensions, weight, consumption of operating materials, operating costs or any information disclosed by Employer(s) through the chat system are not binding and for information purposes only. In entering into the Contract, the acknowledges that it does not rely on and waives any claim based on any such representations or information so provided.

 

    • While the Employer(s) endeavours to provide an accurate description of the posted job, neither Essylifes nor Its Hosts warrants that such description is accurate, current or free from error. If the service requested by Employer is fundamentally different from the job description posted on the Platform and which the Employee has accepted, the Employer(s) takes full responsibility and deems for cancellation and penalty actions to be activated as per Cancellation Policy.

 

    • Any typographical clerical or other error or omission in any posting, invoice or other document or information issued by Essylifes in its App shall be subject to correction without any liability on the part of Essylifes.

 

    • The job seeker may accept the match by clicking Accept button for the match made available on his landing page and the Employer shall be responsible for ensuring the accuracy of the posting All posting shall be subject to Essylifes acceptance in their sole discretion and each match accepted by the job seeker shall constitute a separate Contract and shall be deemed to be irrevocable and unconditional upon transmission through the Platform. Essylifes shall be entitled (but not obliged) to process such orders without further consent from the host and seeker.

8.0 PRICE AND TERMS OF PAYMENT

 

    • Payment and Billing:

The app supports secure payment methods, with the host’s payment temporarily held until job completion and verification.

Detailed invoicing and payment summaries are provided to both hosts and job seekers, including any service charges, additional costs, and cancellation fees.

 

    • All posting of the Jobs placed by Host shall be subject to acceptance by Essylifes App, which acceptance is at the discretion of Jayam Appz Sdn Bhd.
      • The offered rates of the jobs posted shall be as stipulated in the Essylifes App by Host at time of posting.

       

        • The offered rates to be automatically increased when the post not getting match. The increase value based on type of posting.

Short term Posting (Job Commencement less than two (2) days from the posting date and time) Increases by 10% from the offered rate in every 1 hour from the posting time until it reaches maximum 50% when the posting not getting a match within a time frame.

Long Term Posting (Job Commencement more than two (2) days from the posting date and time) Increases by 10% from the offered rate in every 1 day from the posting time until it reaches maximum 50% when a posting not getting a match.

 

    • The rates exclude any applicable sales and services tax, or similar tax which the Job Seeker shall be liable to declare and pay to authorities when submitting their annual income reports to income tax submission.
      • The Host shall be entitled to make payment for the job matched using the various payment methods made available on the Platform. All payments shall be made to Jayam Appz Sdn Bhd or Jayam Appz’s authorised agent or registered financial account.

       

        • Host shall pay for the services required in Ringgit Malaysia using one of the following payment method:

           

            • Online Banking- By choosing this payment method, the Employer/Host shall transfer the amount of the total purchase price for the Voucher/Service purchased by Invitee/Host to a Essylifes account (including any applicable taxes, fees and shipping costs). The transaction must be payable in Ringgit Malaysia. Essylifes, in its sole discretion, may refuse this payment option service to anyone or any user without notice for any reason at any time.

 

    • Credit card – Credit card payment option is available for all Invitee/Host. Essylifes accepts all Visa and Master Cards credit cards and is 3D Secure enabled (verified by Visa and secured by MasterCard). All credit card information of Invitee are protected by industry leading encryption standards. (Please take note that additional charges

may be incurred if Buyer is using a non-Malaysian issued card due to foreign exchange rates.

 

    • Debit Card – Essylifes accepts all Malaysian Visa and MasterCard debit cards, subject to bank availability. All debit card numbers shall be protected by industry leading encryption standards.

Upon verification, Essylifes shall release the salary for the job seeker via payment gateway available in Essylifes. A notification will be sent to job seeker and he/she has to click accept once payment received. Payment release notification will also be sent to Host from Essyifes portal together with a copy of invoice.

Cost of Labor or Visit and Basic Income – to use Auto multiplying system between rate and number of hours) or Fee (per visit) required and accepted..

Additional Cost or Additional Income – if there are additional working hours required and accepted by between seeker and host while doing the job/inspection

Service Charge for Host Essylife will charge RM3.00 minimum for each posting made and successful. . Use Default setting and allow portal admin to amend when requires.

Cancellation Charges – If Hosts cancel an order there will be penalty as mentioned in the cancellation policy. Please read Term C Condition Policy.

Deduction – Seekers who cancel previous job, will have to pay penalty from their next job as per stated in cancellation policy

For SEEKER

Service Charge for Seeker Essylife charges. Default Setting RM 1 per hour/visit. If total working hour or visit is 3, then, the service charge will be RM3.00. The portal administrator should be able to amend if required.

Basic Income – The total income based on number of hour or visit and rate paid per hour or visit.

Additional Cost or Additional Income – if there are additional working hours required and accepted by between seeker and host while doing the job/inspection

Cancellation Deduction – Seekers who cancel previous job, will have to pay penalty from their next job as per stated in cancellation policy.

9.0  DELIVERY

 

    • Delivery of services shall be delivered to the address specified by the Host in the order form posted during a post.
      • The Host has to take full responsibility to ensure there is an authorised person made available at the delivery site to act on behalf them to ensure the delivery of services take place smoothly.
      • Essylifes App give five (5) minutes allowance for Host to response the confirmation of arrival of job seeker at the work site. Any failure to response by the Host, will classified “Host Failed to Response” and therefore the Job will be confirmed as partial completion and the Job Seeker will received 50% of the total offered rate.
      • Essylifes App give fifteen (15) minutes allowance for Host to give job briefing and explanation prior to commence the work. Any failure to response by the Host, will be classified “Host Failed to Response” and therefore the Job will be confirmed as partial completion and the Job Seeker will receive 50% of the total offered rate.
      • Essylifes App give ten (10) minutes allowance for Host to verify and accept a completed job upon job seeker claims job as completed. Any failure to response by the Host, will be classified “Host Failed to Response” and therefore the Job will be confirmed as partial completion and the Job Seeker will receive 100% of the total offered rate.
      • All payment collected by Essylifes from Host may be transferred to Job Seeker in 30 minutes from the job completion accepted time recorded by the Essylifes App.

       

        • Payment for cancellation job or supported with compliant and evidence, shall be hols until further inquiry by Essylifes. All similar reports shall be completed and settled in seven (7) working days after the job completion date specified by the Host.

10.0      Warranties and Remedies

 

    1. Subject as expressly provided in these Conditions, all other warranties conditions or terms, including those implied by statute or common law, are excluded to the fullest extent permitted by law.

 

    1. Essylife warrants that the payout for services offered will correspond with their specification at the time of delivery.

 

    1. Essylifes shall be liable for non-performance, error, interruption or delay in the performance of its obligations under these Conditions (or any part thereof) or for any inaccuracy, unreliability or unsuitability of the Platform’s and/or Services’ contents if this is due, in whole or in part, directly or indirectly to an event or failure which is beyond Essylifes’s reasonable control.

 

    1. No person who is not a party to the Contract (including any employee officer agent representative or sub-contractor of either party) shall have any right to enforce any terms of the Contract which expressly or by implication confers a benefit on that person without the express prior agreement in writing of the parties

11.0 GENERAL Temporary Amount Block for Required Service

Upon getting a match for the posted job, Essylifes will send a reminder to Host based on the payment system to be used, saying an amount (the amount agreed and offered for the service engaged) has been “temporarily hold” from their account for the service they have engaged. The amount will only be deducted from Host account upon service is completed and verified by Host.

Confirmation for Accepted Job.

Job Seeker confirm attendance by clicking Attending Buton. This response will be notified to Host (Employer). This notification should be sending 2 HOURS before job commencement time

Job Seeker who prefers to cancel the attendance by clicking Not Attending Button, Shall click the DECLINE button and a notification message to be released by Essylife App for both Host and Essylifes Customer Service.

Essylifes will conduct Auto Search by activating new job message to extensive area. The rate will be Auto Increase to 20% from final rate. If still fail to find a new seeker within 30 mins, the rate will be increase to 40% from the final rate to next 30 mins. If still no Seeker Grab the job, then the order need to be cancelled and Employer (Host) need to be advice. Essylifes customer service will contact Employer (Host) to offer alternative options over phone call or email or whastapp message.

Tracking and Movement Monitoring

Prior to going/moving to work place, the seeker who has taken the job MUST press On The Way button. Once he pressed On The Way Button, the navigator button appears on seeker’s screen and seeker to click Navigator Button to find the 3rd party navigation map. The navigation start point is based on following scenarios:

Start Location – Live location of the Seeker (Probably seeker need to key in the address or auto detect)

Work Location – As per given by Host during posting . Host will not allowed to change work location . Once the seeker has pressed on the way button and choose the 3rd party navigation map, the

DURATION (Time) taken (duration in time) should appear in both Job Seekers and Host Essylifes screen.

Notification for Booking Confirmations:

Bookings confirmation made for jobs within 24 hours, the accepted job seeker will get a reminder notification to and to click “confirm” button in app at least two (2) hours before job commencement time to ensure Job Provider get confirmation notification. The confirmation will also receive by employee portal at Essylifes portal. The App MUST send reminder to the Job Seeker to do the confirmation.

Notification for Advance Bookings (more than 24 hours)

 

For advance bookings arrangements (More than 24 hours), the Job Seeker will get a reminder notification 24 hours before job commencement and to click “confirm” button in app to ensure Job Provider get confirmation notification. The confirmation will also receive by employee portal at Essyife portal. The App MUST send reminder to the Job Seeker to do the confirmation.

The Job seeker rejects the job (cancel) during the reconfirm notification, Essylife will do the following.

 

    1. Will take necessary action against the job seeker (will explain in cancellation policy)

    1. Will immediately notify Host and agreed to do the best to find a replacement worker

    1. Essylife will conduct a new search to find a new seeker by using ultra search methods. Here Essylife may need to offer extra fee for the job and are willing to absorb the additional cost.

 

    • In the event, no replacement is found, Essylife will immediately inform the Host (using in app notification and/or customer service to call or email, developer top advice). Will arrange to refund Host’ money at full within 48 hours of a cancellation made or offer Host alternative work time. Any additional cost, will be absorbed by Essylife. The customer service should be able to exercise this and linked to the Essylife Admin portal system.

DO s DON’TS for HOST

Host can review the details of matched seekers details once the job receives a match.

Host can revise the posted job if not getting any matches. Revision can be done to offered rate, work location, job description, job specifications, and seekers criteria.

Host can post multiple jobs at a time using the same user name Host can post any number of seekers required for a single post Host shall provide seekers with all the details as per posted

Host shall give the rest time required by labour law for jobs exceeding four (4) hours.

Host cannot change work details for matched posting. This includes changes to the offered rate, description, job seeker criteria work location.

Any changes to working hours for matched post can be directly discussed and done with the matched job seekers during work in progress. Host can only increase work hours for the same job seeker if the job seeker has at least one hour between the completion of extended hour and the next commencement job. Terms and Conditions apply.

Any changes to work description of the matched post, host can be directly discussed and done with the matched job seekers during work in progress. There should not have any impact on cost. Terms and Conditions apply.

Any cancellation for matched job may cause penalty charges for Host.

Host are not encouraging to request seekers decline the matched posting and contact seekers directly without using the app. Essylifes strictly prohibits such actions and actions can be taken if proven.

DO s DON’TS for JOB SEEKER

Job Seeker can register maximum three (3) type of preferred jobs from the listing available in the Essylifes App

Job Seeker can register maximum three (3) preferred work location for each registration made

Job Seeker are required to give honest and genuine personal details and the preferred work- related details

Job Seeker may be required to submit supporting documents if necessary for the selected jobs during registration

Job seekers can amend and edit the selection of preferred jobs and locations at any time Job seekers cannot accept multiple jobs commencing at same time

Job seekers must ensure there is a minimum of two (2) hours between the completion of previous job and any new jobs accepted.

Job seeker is required to be on time for jobs and actions will be taken for failure to comply. Term and Conditions Apply.

Job seekers cannot switch his/her matched job with anyone without prior notice to Essylifes and approval is pending to Essylifes jurisdiction. Terms and conditions apply.

Job seekers cannot contact Host directly for any potential cancellation

Jobs seekers cannot directly contact Host and offer replacement for the job matched for them.

Job seeker has potential to be banned from using Essylifes App for wrong information and faulty guilty trying to give fake details

Job seekers should always follow the work ethics and guidelines

Job seekers are suggested to do some “homework” about the matched job Job seekers shall strictly comply the “house rules” when at work site

Job seekers shall not be rude, wild and show aggressive behaviours to the Employer

12.0  GOVERNING LAW

The Contract shall be governed by and construed in accordance with the laws of Malaysia. The parties hereto submit to the non-exclusive jurisdiction of the courts of Malaysia, that being the place where Customer’s order has been received and/or entered and accepted.

13.0    FORCE MAJEUR

17.1 Neither Party shall lose any rights hereunder or be liable to the other Party for damages or losses (except for payment obligations) on account of failure of performance by the defaulting Party if the failure is occasioned by war, strike, fire, Act of God, earthquake, flood, lockout, embargo, governmental acts or orders or restrictions, failure of suppliers, or any other reason where failure to perform is beyond the reasonable control and not caused by the negligence or intentional conduct or misconduct of the nonperforming Party, and such Party has exerted all reasonable efforts to avoid or remedy such force majeure; provided, however, that in no event shall a Party be required to settle any labour dispute or disturbance.

14.0 USE AND DISCLOSURE OF DATA

 

    1. The Host/Job Seeker agrees that Essylifes shall be entitled to use or disclose any information or data disclosed by the Host/Job Seeker in accordance with Essylifes Privacy Policy. The User is entitled to withdraw such consent in the procedure as prescribed by Essylifes from time to time.

15.0 CANCELLATION

In the event the posting is cancels by Host after received match(s) or by the matched Job Seeker(s), Essylifes will impost the cancellation policy. Please read the cancellation policy and terms.
